A German appeals court in Karlsruhe has now overturned the ruling that banned Apple from selling some of its products in the country, reports Skynews.
Motorola Mobility had filed a lawsuit against Apple, accusing the latter of certain patent infringements. The lawsuit was filed against Apple’s 3G iPhone, iPad and its remote storage service iCloud.
There is a system in place called Frand (fair, reasonable and non-discriminatory) as per which the companies give licenses to other companies to use their patented technologies, which are part of crucial industry standard.
In the present face-off, Motorola’s patent in question is considered to be critical for GPRS data transmission standard used by GSM cellular networks across the world. Companies are obliged to give licenses for using their crucial Frand-type patents at a reasonable price to anyone willing to pay.
Apple in a statement has said that it is ready to pay the fee but the main point of contention between these tech majors is that how much the Cupertino Company must pay for failing to license the technology up until now. This situation gives Motorola an upper hand as the “reasonable” rule does not provide for any such situation of missed payments, and it may demand much more fee.
According to Apple, company’s products like iPhones and iPads – will once again be available in Germany soon through official online stores.
“All iPad and iPhone models will be back on sale through Apple’s online store in Germany shortly,” Apple said in a statement. “Apple appealed this ruling because Motorola repeatedly refuses to licence this patent to Apple on reasonable terms, despite having declared it an industry standard patent seven years ago.”
In turn, Motorola has announced that it will pursue its fight lawsuit with Apple in the court and try to get the ban implemented again.
Litigation between Motorola and Apple has been continuing since 2010. All this time, companies have continued to exchange counter-claims, accusing each other of patent infringement. Motorola has made claims against almost all the products of Apple.
